Job Description:

The Associate Counsel - Labor & Employment will be a member of Acadia Healthcare’s Legal Department, reporting to the Executive Vice President, General Counsel of Acadia.  The role is responsible for advising Acadia’s facilities and HR department in the management and handling of all labor and employment matters in the Company.


ESSENTIAL FUNCTIONS:

  • Provide legal counsel and strategic advice to the firm on employment law and related matters, and prepare and review human resources policies, procedures, agreements and other documentation related to human resources and workforce management.
  • This attorney position will oversee a docket of employment cases at various stages from threatened litigation through trial, in various jurisdictions.
  • Advise on all U.S. based employment laws including but not limited to, ADA, FMLA, Title VII, Wage & Hour, local discrimination/harassment laws, Leave laws; as well as the application of the Fair Labor Standards Act, Labor Management Relations Act and other federal and state legislation
  • Assist in the creation, administration and implementation of the organization's policies and HR/ER programs, policies and procedures.
  • Partner with the business teams to investigate employment concerns, mediate workplace conflicts, and prepare and coordinate disciplinary actions.
  • Provide consultation, guidance and coaching to address employee behavior and performance concerns, and provide guidance and assist with the development and delivery of appropriate feedback or corrective/disciplinary actions.
  • Resolve issues by applying relevant employment laws, policies, past practices and/or best practices.
  • Create and provide training on various employment law issues
  • Assist with managing litigation, claims and disputes and advise internal business clients on such matters. 
  • Hands-on advice and counsel to various internal clients to proactively address and resolve potential disputes while providing risk mitigation advice to business clients while supporting business objectives

 

EDUCATION/EXPERIENCE/SKILL REQUIREMENTS:

  • 4+ years of experience in Employment Law
  • Attorney must be licensed to practice law and a member in good standing in in the state/jurisdiction in which the position is based or otherwise in compliance with the in-house counsel registration rules of that state/jurisdiction
  • Demonstrated knowledge of state and federal employment discrimination and other employment-related statutes, as well as common law employment claims
  • Experience handling full range of labor and employment issues, including performance management, employee discipline, termination, severance, workplace investigations, policy development, employment agreements, FLSA, FMLA, wage and hour issues, workplace accommodations, applications, training, and incentive pay.
  • Ability to comprehend, analyze and resolve complex employee problems and effectively communicate rationale with key stakeholders, while remaining sensitive to employee concerns and adapting to different, sometimes conflicting stakeholder needs
  • Strong organizational skills and ability to handle high volume and balance competing demands
  • Ability to develop and maintain client relationships; must be an effective influencer
  • Employment litigation and counseling.
  • Project management skills and background
  • Excellent oral advocacy, analytical and writing skills are required.
  • Juris Doctor required. 
  • Qualified candidates must be and remain licensed to practice law and in good standing in the state of employment. 
  • Ability to work professionally with sensitive, proprietary data & information while maintaining confidentiality.
  • Excellent interpersonal skills including the ability to interact effectively and professionally with individuals at all levels; both internal and external.
  • Exercises sound judgment in responding to inquiries; understands when to route inquiries to next level.
  • Self-motivated with strong organizational skills and superior attention to detail.
  • Must be able to manage multiple tasks/projects simultaneously within inflexible time frames.  Ability to adapt to frequent priority changes.
  • Capable of working within established policies, procedures and practices prescribed by the organization.
